Terms of Service Agreement (Effective December 4, 2008)

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. MANY WILL ENTER, ONE WILL WIN.

1. Eligibility: Onceanhour is open only to legal residents of Canada , India and the fifty (50) United States, the District of Columbia and Canada (excluding Quebec) who are at least thirteen (18) years old at the time of entry. Void in Quebec and whereever restricted or prohibited by law. Employees, officers and representatives of Attract Ventures Pvt Ltd, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, provincial, territorial and local laws and regulations. Participation in the Contest constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Game. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Onceanhour Daily Contest begins at 1:00 a.m. Eastern Time ("ET"), January 1st, 2009 and ends at 11:59 p.m. ET, January 31st, 2009 (the "Promotion Period"). Administrator’s computer is the official time keeping device for the Instant Win Game.

4. How to Enter: MANY WILL ENTER, ONE WILL WIN. The Contest is open to age eighteen (18) and over, however, parents/legal guardians can register and participate in the Onceanhour Contest on behalf of their children who are under age eighteen (18). Children under age eighteen (18) are not permitted to register for the Onceanhour Contest. Upon arriving at the Seller’s Section landing page, the seller/parent or guardian will view promotional messaging which details how to gain entry into the promotion.

Register: During the Promotion Period, the user will go to http://www.onceanhour.com and click on the New Player Registration Link, fill out the online entry form completely, and submit the form. Once the user submits the form, the user will follow the directions to advance to the Onceanhour Daily Contest page and to play Everyday Contest. It is recommended that Macromedia Flash be installed on the user’s computer (if it is not already installed) when prompted. Installation is free. Once on the page, follow the links and instructions to play the Contest. Entries must be submitted by playing the contest online in full and may not be submitted on paper or by mail. Only one entry is allowed per person, per day. A Player who Plays all the 3 Question types and wins maximum points will Win that Days Prize Money. Limit ONE (1)ENTRY (i) PER PERSON (REGARDLESS OF THE NUMBER OF EMAIL ADDRESSES OR REGISTERED MEMBER ACCOUNTS), or (ii) PER EMAIL ADDRESS (REGARDLESS OF WHETHER MORE THAN ONE PERSON USES THE SAME EMAIL ADDRESS).The user will be notified if he/she is a potential instant winner via email specified in the registration form. All entries become the property of Onceanhour and will not be acknowledged or returned. Onceanhour assumes no responsibility for lost, late or misdirected entries or for any computer, online, internet, telephone or technical malfunctions that may occur. Any information submitted as part of the entry is subject to Onceanhour’s Privacy Policy posted on this website. This winner’s page will display a winner’s First Name, Last initial, and city of residence the Next day. Entrants will be notified the next day by email if they are potential winners of the Onceanhour Daily Contest and will be provided directions for validation. All potential winners are subject to verification before any prize will be awarded. Administrator is responsible for the functionality of the Daily Contest.

Limit: Each participant may play once per day by any method or combination of methods of entry during the Promotion Period. Multiple participants are not permitted to share the same identification number. Any attempt by any participant to obtain more than the stated number of plays by using multiple/different identification numbers, identities, registrations and logins, or any other methods will void that participant's plays and that participant may be disqualified.

Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the email address/identification number used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address and/or the natural person assigned the identification number by Sponsor. Potential winners may be required to show proof of being the authorized account holder..

5. Alternate Method of Entry: To Enter and Play Onceanhour Daily Contest without registering online please send an email to memberregistration@onceanhour.com , Our Administrator will collect required details from user and provide him with a username and password using which the member can play online and compete, the same rules as in Point 5 applies here.

6. Contest Details : Every Day a Registered Member once registered can login at www.onceanhour.com between 1am EST and 11.59 pm EST using his registered username and password, once logged in based on users profile, 3 questions will be shown, these can be knowledge based, Ad Based and Games, depending on your profile questions change from player to player. Below is the explanation of question types

i) AD memory - A commercial will be shown and based on the video you see or audio you hear and you will be asked a question , you have four multiple answers out of which only one answer is right, this is profile based and different questions can be served to differnet people based on profile

ii) Knowledge - In this Category , you will be asked a knowledge based trivia question based on the categories you have chosen to answer, you can change your categories of preference anytime by editing your Profile , this question will be different for each user

iii) Game - In this Category you will be asked to play a game and win maximum points, currently the game is same for all the users, In the future we Provide you the option to choose your game of interest from our available set

Points / Scoring Mechanism and Time: Ad Memory and Knowledge questions have maximum 24 Seconds (24000 milliseconds) to answer and Each Question Caries 24000 points, one point for every milli second

The fastest right answer will get you maximum points and fastest wrong answer will make you lose the maximum points, questions unanswered in less than 24 seconds will get you zero points

In the Game you have six arrows to hit and the maximum score you can make is 24000 points for these 6 shots

Restrictions: A Player can view a question only once and answer only once from his login per day

Daily Winner: A Registered Player who plays and gets the maximum score or Points before 11.59pm EST that day will win that day’s prize money

Monthly Winner: A Registered Player who plays and gets the maximum consolidated score starting from the day 12/04/2008 8am and ending on 12/31/2008 11.59pm EST will win Monthly prize money

Points Expiry: Accumulated Points Expire at the End of the Month i.e on 01/31/2009 11.59pm EST

7. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE ONCEANHOUR DAILY CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.

8. Prizes and Winners: Sponsor will award Only one (1) "1st Place Prize," of $10 USD Cash as a Paypal Payment, Every Day to the entrant who accumulates the highest points before the end of the Day and in each the Daily Contest , and will award Only one (1) "1st Place Prize," of $100 USD Cash as Cheque at the End of the Month to the entrant who accumulates the highest points playing regularly in between 01/01/2009 1am EST till 01/31/2009 11.59 pm EST as Monthly Prize Winner

9. Ties: Should a tie exist between two (2) or more entrants for any of the Daily prizes, a player whose Monthly Points are the highest at the end of that day among the tied players will win. However, Sponsor may, in its sole discretion, elect not to break a tie and instead to award prizes to all eligible winners (or to all eligible winners then remaining after applying one (1) or more tiebreaker rules).

10. Odds of winning prizes depend on the Total Score Made by each player and a player who makes the highest score wins.

11. Substitution; Taxes; Prize Restrictions. No other prize substitution, assignment or transfer of prizes permitted, except at Sponsor's sole discretion due to prize unavailability. Sponsor reserves the right to substitute a prize with one of comparable value or greater value (e.g., Sponsor may opt instead to award the cash equivalent, up to but not greater than the ARV, of any prize in lieu of the prize itself).THE WINNER IS SOLELY RESPONSIBLE FOR ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE.

12. Prize Delivery. Prize winners should allow up to 6-8 weeks after they return their signed, notarized affidavit to receive their prize. Prizes returned as undeliverable or otherwise not claimed within fourteen (14) days after being sent will be forfeited.

13. No Warranty. Entrants acknowledge that Sponsor and its respective agencies or related companies have not made nor are in any manner responsible for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality. The only warranty for any prize is the standard limited written warranty from the prize's manufacturer, if any, which may be included with, and applicable to, the prize.

14. Publicity: Except where prohibited, participation in the Onceanhour Daily Contest constitutes winner's consent to Sponsor's use of winner's name, likeness, photograph, voice, opinions, biographical information, hometown and state (or province/territory) for promotional purposes in any media without further payment or consideration.

15. General Conditions: Sponsor reserves the right to cancel or modify the Onceanhour Daily Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Instant Win Game, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Onceanhour Daily Contest or to be acting in violation of these Official Rules or any other Promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Onceanhour Daily Contest is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

16. Release: By receipt of any prize, winner agrees to release and hold harmless Attract Ventures Pvt Ltd., and any promotional partners, each of their parent, subsidiary, affiliate and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Onceanhour Daily Contest or resulting directly of indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Instant Win Game, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.

17. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Daily Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest ; (4) technical or human error which may occur in the administration of the Onceanhour Daily Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Onceanhour Daily Contest or receipt or use of any prize or while traveling to or from any prize-related activity. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Daily Contest; provided that if it is not possible to award another entry due to discontinuance of the Onceanhour Daily Contest for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

18. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with Onceanhour Daily Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Hyderabad, A.P , India ; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Onceanhour Daily Contest but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Onceanhour Daily Contest, shall be governed by, and construed in accordance with, the laws of the State of Andhra Pradesh, India, without giving effect to any choice of law or conflict of law rules (whether of the State of Andhra Pradesh or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Andhra Pradesh.

20. Winners List For Major Prizes: Onceanhour Daily Contest results of the winners and/or a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to the " Onceanhour Contest Every Day” Winner List/Official Rules Request”, c/o Attract Ventures Pvt Ltd., Hyderabad, India. Requests must be received by December 31, 2008, for the Winners List.

21. GAMBLING PROHIBITION: This Promotion is strictly for entertainment purposes and is a Game of Skill that involves, knowledge , Memory and Skill and may not be used in connection with any form of gambling.
